Terms and conditions for use of the JET Preprints and Reports Service

1. Definitions

In these terms and conditions for use of the JET Preprints and Reports service and elsewhere in this World Wide Web site the following expressions shall have the following meanings:

"Content Files" means the text files available in accessing JET Preprints and Reports service held on IOP Publishing Ltd's servers (and which contain the text of articles, reviews, etc., otherwise available as preprints, reports, conference papers, but excluding the text of "help" pages contained in that service).

"Files" means all binary files and text files (including, but not limited to, the HTML files, Adobe Acrobat PDF files and graphics files) available in accessing the JET Preprints and Reports service held on IOP Publishing Ltd's servers and their renderings created either directly or indirectly (including images created through interpretation or translation of these files into other formats, including, but not limited to, printed pages) together with the layout, design and appearance of the pages on the JET Preprints and Reports service but excluding the Content Files.

2. Availability

JET shall use all reasonable endeavours to make the Server available to the User on a 24 hour basis but, if the User's access is suspended or interrupted or a fault or defect occurs which prevents access to the Server, JET's liability shall be limited to restoring access to the Server as soon as is reasonably practicable. Save as set out above JET shall have no further liability to the User in respect of any suspension or interruption of access to the Server. The User recognises and accepts that the Server may become temporarily unavailable owing to reasons entirely outside JET's control.

Disclaimer

3.1

The JET Preprints and Reports service, the Content Files and the Files are provided on an "as is" basis without any representation or warranty of any kind, either express or implied including, but not limited to, any warranty as to satisfactory quality, merchantability, fitness for a particular purpose or non-infringement of any party's rights. JET and/or IOP Publishing Ltd or their respective agents may make improvements and/or changes to the information in the Content Files or to the Files and the products and services described in the Content Files at any time. The appearance and pagination of the Content Files may differ from that of the printed version published by JET. The printed version published by JET should be regarded as the definitive version and used for citation purposes.

3.2

Except as specifically stated in this service, neither JET nor IOP Publishing Ltd or any of their directors, employees or other representatives will be liable for loss or damage arising out of or in connection with the use of this World Wide Web site, the Files or the Content Files. This is a comprehensive limitation of liability which applies to all damages of any kind, including (without limitation) compensatory, direct, indirect or consequential damages, loss of data, income or profit, loss or damage to property and claims of third parties. This limitation of liability does not affect the statutory rights of the User.

Statement Of Copyright

JET Preprints and Reports service is copyright © IOP Publishing Ltd 1994, 1995, 1996, 1997 and 1998. All Content Files are copyright JET 1996, 1997 and 1998. ALL RIGHTS RESERVED. No Content File may be reproduced,stored in a retrieval system or transmitted in any form or by any electronic, mechanical, photocopying, recording or otherwise without the written permission of JET, except in accordance with the fair dealing provisions set out below.

The Files are copyright © IOP Publishing Ltd 1994,1995, 1996, 1997 and 1998 and may not be reproduced, stored in a retrieval system or transmitted in any form or by any means electronic, mechanical, photocopying, recording or otherwise without the written permission of IOP Publishing Ltd except in so far as may be permitted by law.

Fair Dealing

5.1

Single printed versions of individual Content Files may be made for private study or research.

5.2

Single copies of individual Content Files may be held in computer memory and displayed on computer screen for private study or research.

ALL OTHER PROPRIETARY RIGHTS ARE RESERVED

Data Protection Notice

6.1

The data subject hereby freely gives consent to the specific data above being processed and understands that it will be used solely for inclusion in the JET database. JET undertakes to ensure that the data is processed fairly and lawfully and that the data has been collected for specified explicit and legitimate purposes. At any time the data subject may view the data, may obtain the recipients or categories of recipients to whom the data are disclosed and has the right to amend and keep up to date the data or may object to the processing of personal data. General

The statement of copyright and the other terms relating to access to the Server and the use of this service are governed by English law. If any provision of these terms shall be held by a Court or tribunal of competent jurisdiction to be void, unenforceable or contrary to law, it shall be severed from these terms which shall continue in full force and effect as if the offending provision had never been included.
